Distance Sales Contract

This Distance Sales Contract (the "Contract") is concluded electronically, through the environment provided by Skyway Travel in its capacity as intermediary service provider, between the BUYER who purchases an event ticket via the RaveHunt platform (ravehunt.com) operated by SKYWAY TRAVEL TURİZM SEYAHAT TİCARET LİMİTED ŞİRKETİ and the SELLER (the event organizer) who offers that ticket, pursuant to Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts. Before confirming the order, the BUYER declares having read and electronically accepted all terms of this Contract.

1. Parties, Operator and Intermediary Service Provider

SELLER / SUPPLIER: The seller of the event ticket subject to this Contract is the EVENT ORGANIZER who creates and stages the relevant event. The organizer's trade name, address, tax details and contact information are displayed to the BUYER at the moment of purchase, on the relevant event page and in the order summary. The SELLER is directly responsible for performing the service (the event) that the ticket represents.

OPERATOR / INTERMEDIARY SERVICE PROVIDER: SKYWAY TRAVEL TURİZM SEYAHAT TİCARET LİMİTED ŞİRKETİ (in short, Skyway Travel). RaveHunt is the name of the brand and platform operated by Skyway Travel. Skyway Travel does not sell tickets on its own behalf; it acts as an intermediary service provider / marketplace that brings the SELLER and the BUYER together and supplies the payment, ticketing and digital delivery infrastructure, in return for a service fee.

BUYER (CONSUMER): The natural person who creates an account on the RaveHunt platform and purchases an event ticket. The BUYER's name, e-mail and billing details are recorded as declared by the BUYER during the order process.

2. Definitions

Platform: The social and ticketing service for music events that Skyway Travel provides over the web under the RaveHunt brand at ravehunt.com. At this stage the application is used solely via the web; a mobile application is not yet live.

Ticket: A personal, digitally generated electronic document carrying a QR code that grants the right of admission to a specific event.

QR Code: The digital code scanned at the event entrance to verify the ticket's validity and the right of admission.

Wallet: The digital ticket area within the BUYER's platform account where purchased tickets are collected.

BPM: An in-app loyalty point. It is not money, cannot be converted to cash and is not a substitute for money; it is earned on each app sign-in and at certain events, and can only be used within the uses defined by the platform (for example, admission to some events with BPM).

3. Subject and Scope of the Contract

The subject of this Contract is the sale and delivery of the event ticket (digital QR ticket), whose characteristics and sale price are stated on the relevant event page and which the BUYER orders electronically through the Platform, together with the determination of the parties' rights and obligations within this scope.

The product subject to this Contract is not a physical good but a digital service / ticket granting the right of admission to an event held at a specific date and place. The venue, date, time, age limit and any special conditions of the event are presented to the BUYER on the event page prior to purchase.

Before completing the purchase, the BUYER acknowledges having read and electronically approved the SELLER's identity, the essential characteristics of the ticket, the total price including taxes, the payment and delivery method, the information regarding the right of withdrawal, and all terms of this Contract.

4. Delivery of the Ticket and Free Transfer

Delivery takes place digitally. Once payment is confirmed, the ticket is generated electronically and drops into the Wallet in the BUYER's platform account. The QR-coded ticket is displayed via the Wallet and scanned at the event entrance; no physical shipment is made.

The ticket is personal. The BUYER may transfer the ticket to another user (a friend) only through the in-platform transfer feature and ONLY FREE OF CHARGE. After transfer, the right of admission passes to the recipient.

Selling the ticket for a price, bartering it, offering it on the black market, or reselling it outside the platform is STRICTLY PROHIBITED. In case of breach of this prohibition, the relevant ticket may be cancelled, admission may be refused, and action may be taken regarding the user account.

The BUYER accepts that the QR code on the ticket is single-use and cannot be reused once scanned at entry, and that the BUYER is responsible for any consequences arising from sharing the QR code with third parties.

5. BPM Points

BPM is an in-app loyalty point designed to reward engagement with the platform. BPM is not money; it cannot be claimed as cash or a bank balance, cannot be transferred to third parties, and does not substitute for the price of a product / ticket.

BPM is earned on each app sign-in by the user and at certain events determined by the platform; it can only be used within the uses defined by the platform (for example, admission to some events with BPM).

The rules, rates and validity periods for earning and spending BPM are determined and may be updated by Skyway Travel within the framework of the platform rules. BPM bears no direct monetary relationship to the ticket sales made with money under this Contract.

6. Price, Service Fee and Payment

The sale price of the ticket is shown on the relevant event page in Turkish Lira (TL), inclusive of taxes. The service fee that Skyway Travel charges for its intermediary service is disclosed to the BUYER in the order summary, either separately or included in the total amount. The BUYER sees the total amount payable before confirming the order.

Payment is collected electronically through a payment provider / payment institution. The payment system integration will be established separately; payment card details are not stored by Skyway Travel and are processed through the secure infrastructure of the relevant payment provider.

The SELLER is obliged to issue an invoice for the ticket item offered. Skyway Travel issues, in its own name, the document relating to the service fee it charges. The BUYER's invoice is delivered electronically in accordance with the legislation.

If payment fails for any reason or is cancelled by the bank / payment provider, no ticket is generated and no delivery obligation arises.

7. Right of Withdrawal and Its Exception

Pursuant to Article 15, first paragraph, subparagraph (g) of the Regulation on Distance Contracts, the consumer HAS NO RIGHT OF WITHDRAWAL in respect of services relating to leisure-time activities carried out for entertainment or recreation purposes that must be provided on a specific date or period.

Since the event tickets subject to this Contract grant the right of admission to an entertainment / event service taking place at a specific date and time, they fall within the scope of that exception. Accordingly, the BUYER CANNOT exercise the 14-day right of withdrawal with respect to the event ticket purchased.

The BUYER declares having been clearly informed of this exception before purchase and having accepted it upon order confirmation. The absence of the right of withdrawal does not eliminate the refund rights arising from cancellation / postponement set out in Article 8 below.

8. Cancellation, Postponement and Refund Conditions

If the event is CANCELLED by the SELLER (organizer), the ticket price paid by the BUYER is refunded within the period prescribed by law and to the method by which payment was made. The refund of the service fee is assessed within the framework of the relevant legislation and platform rules.

If the event is POSTPONED or its date / venue changes, the ticket, as a rule, remains valid for the new date and venue. If the new conditions are not suitable for the BUYER, a refund may be requested within the framework of the conditions announced by the organizer and the legislation. Postponement and refund conditions may additionally be announced on the event page.

For refund requests, the addressee is, as a rule, the organizer who is the seller of the ticket; Skyway Travel, in its capacity as intermediary service provider, technically facilitates the operation of the refund process and the execution of the refund with the payment provider.

Buyer-related reasons such as the BUYER voluntarily not attending the event, arriving late, or failing to comply with the admission rules (18+ age, presentation of ID, capacity, security) do not give rise to a right of refund.

The refund amount is calculated over the actual price of the ticket; since BPM points carry no monetary value, they are not converted to cash within the scope of a refund.

9. Account Creation, Google / Apple Sign-in and the 18+ Requirement

To access the platform, the BUYER creates a user account by signing in with e-mail or with a Google or Apple account. Sign-in with Google and Apple is used solely for identity verification; the terms of use of these methods belong to the relevant provider (Google / Apple).

The Platform and events are for those AGED 18 AND OVER. The BUYER declares and undertakes to have completed the age of 18 at the time of order. Age and identity verification may be carried out at the event entrance; persons found to be under 18 may be refused admission, in which case no refund arises as it is a buyer-related reason.

The BUYER accepts that the information provided during the order is accurate and up to date, and that the BUYER is responsible for the security of the account and the ticket.

The BUYER undertakes to use the ticket only in the manner defined in this Contract (personal use or free in-platform transfer), and not to resell it for commercial purposes, offer it on the black market, or misuse the QR code. The BUYER is also obliged to comply with the security, admission and conduct rules of the organizer and the venue on the event premises.

10. Position of the Intermediary and Limits of Liability

Skyway Travel (RaveHunt) is not the organizer of the event or the seller of the ticket; it is the INTERMEDIARY SERVICE PROVIDER that enables the distance sale transaction between the SELLER and the BUYER to be concluded electronically. The content, quality, program, artist line-up, security and performance of the event are the responsibility of the SELLER (organizer).

Skyway Travel's liability is limited to the operation of the platform, ticketing, digital delivery and payment intermediation services it provides. Skyway Travel fulfils the obligations imposed on intermediary service providers by the relevant legislation.

The parties cannot be held liable, within the framework of the legislation, for the non-performance of obligations due to force majeure (unforeseeable events such as natural disaster, epidemic, fire, decisions of official authorities, and infrastructure and communication outages). In such cases, the provisions of Article 8 regarding cancellation or postponement of the event apply.

11. Resolution of Disputes

The BUYER may first submit claims and complaints arising from this Contract to contact@ravehunt.com. Skyway Travel, in its capacity as intermediary, makes reasonable efforts to forward the request to the relevant SELLER and to support the resolution process.

For disputes arising from this Contract, the CONSUMER ARBITRATION COMMITTEES at the BUYER's place of residence or at the place where the transaction was carried out have jurisdiction within the monetary limits announced annually by the Ministry of Trade, and the CONSUMER COURTS have jurisdiction for disputes above those limits.

The BUYER may, if desired, file an application through the Consumer Information System (TÜBİS) or the relevant official channels.

12. Entry into Force, Contact and Applications

This Contract is concluded and enters into force at the moment the BUYER confirms the order summary and electronically completes the payment step. A copy of the Contract is kept accessible in the BUYER's account and / or at the BUYER's e-mail address.

For ticket- and event-specific requests, the addressee is primarily the relevant SELLER; the BUYER may also request routing through the RaveHunt support channel (contact@ravehunt.com).
